Terms of Service

These Terms of Service ("Terms") govern access to and use of the oceks.com website and, unless superseded by a signed agreement, the AIOPS platform (together, the "Services") provided by OCEKS LLC ("OCEKS").
1. Agreement
By accessing the Services you agree to these Terms. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization. Enterprise and Sovereign customers are governed primarily by their signed master service agreements; where those conflict with these Terms, the signed agreement controls.
2. The Services
AIOPS is an AI governance platform providing compliance assessment, evidence generation, monitoring and policy enforcement capabilities. Compliance scores and classifications produced by the platform are tools to support your compliance program; they do not constitute legal advice, and responsibility for regulatory compliance remains with your organization.
3. Accounts and acceptable use
- You are responsible for safeguarding credentials and for activity under your accounts.
- You may not attempt to gain unauthorized access to the Services, disrupt their operation, or use them to violate applicable law.
- Security research is welcome through coordinated disclosure via [email protected].
4. Customer data
Your organization retains all rights to the data it submits to the platform, including model documentation, assessment inputs and evidence packages. OCEKS processes such data only to provide the Services, as described in the Privacy Policy and applicable data processing agreements. In self-hosted and air-gapped deployments, customer data remains within the customer's infrastructure.
5. Open-source components
Certain components (including the rules engine, evidence schema and Kafka SDK) are made available under their own open-source licenses, which govern their use independently of these Terms.
6. Intellectual property
OCEKS retains all rights in the Services, excluding customer data and open-source components. Feedback you provide may be used to improve the Services without obligation.
7. Fees
Paid tiers are billed per the applicable order form. Where a service-level agreement applies, service credits are computed and applied automatically as described in that agreement.
8. Disclaimers
Except as expressly stated in a signed agreement, the Services are provided "as is" without warranties of any kind, whether express, implied or statutory, including fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, OCEKS shall not be liable for indirect, incidental, special, consequential or punitive damages, and its aggregate liability under these Terms shall not exceed the amounts paid by you for the Services in the twelve months preceding the claim.
10. Termination
You may stop using the website at any time. Platform subscriptions terminate per the applicable agreement. We may suspend access that threatens the security or integrity of the Services, with notice where practicable.
11. Changes and governing law
We may update these Terms by posting a revised version with an updated date. These Terms are governed by the laws of the United States and the state in which OCEKS LLC is organized, without regard to conflict-of-law rules.
